Introduction
The Skate Lab operates this store and website, including all related information, content, features, tools, products, and services, to provide you with a curated shopping experience (the “Services”). The Skate Lab is part of the Imperial Crown family of brands. Our store is powered by Shopify, which enables us to provide the Services to you.
This Privacy Policy describes how we collect, use, and disclose personal information when you visit or use the Services, make a purchase or other transaction, or communicate with us. If there is a conflict with our Terms & Conditions, this Privacy Policy controls in relation to the collection, processing, and disclosure of personal information.
Please read this policy carefully. Using the Services acknowledges receipt of this information; it does not by itself provide consent for processing where separate consent is required by law.
Personal Information We Collect or Process
“Personal information” means information that identifies, or can reasonably be linked to, you or another person. It excludes information that is genuinely anonymous or de-identified so that it cannot reasonably identify or be linked to a person.
Depending on your interactions with the Services, your location, and applicable law, we may collect or process the following categories, including inferences drawn from them:
- Contact details: name, address, billing and shipping addresses, telephone number, and email address.
- Financial and payment information: payment card and financial account information, transaction details, payment method, payment confirmation, and other payment details. The information available to us depends on the payment provider and payment method used.
- Account information: username, password, security questions, preferences, and settings, where applicable to the account features you use.
- Transaction information: items viewed, placed in your cart or wishlist, purchased, returned, exchanged, or cancelled, and past transactions.
- Communications: information you provide when contacting us, including customer support enquiries.
- Device information: device, browser, network connection, IP address, and other unique identifiers.
- Usage information: how and when you interact with and navigate the Services.
Sources of Personal Information
We may collect information:
- Directly from you when you create an account, use the Services, contact us, or provide information.
- Automatically through your device, your use of our website or Services, and cookies or similar technologies.
- From service providers that supply technology or process information on our behalf.
- From business partners or other third parties, where permitted by law.
How We Use Personal Information
Providing, Personalising, and Improving the Services
We use information to perform our contract with you, process payments, fulfil orders, arrange shipping, handle returns and exchanges, manage accounts, remember preferences and items of interest, send account and transaction notifications, enable reviews, recommend relevant products, and improve the shopping experience and Services.
Marketing and Advertising
We may use information to send promotional communications by email, text message, or postal mail and to show advertisements on our Services or other websites, including advertisements based on purchases, cart contents, or other activity. This is subject to applicable consent requirements and your choices.
Security and Fraud Prevention
We use information to authenticate accounts, secure payments and the Services, detect and investigate potentially fraudulent, unlawful, unsafe, or malicious activity, and protect public safety. You are responsible for keeping your account credentials secure and should not share them with others.
Communicating With You
We use information to respond to enquiries, provide customer support, deliver effective Services, and maintain our business relationship with you.
Legal Purposes
We use information to comply with applicable law and valid legal process, respond to lawful requests from public authorities, investigate or participate in legal proceedings, and enforce or investigate potential breaches of our terms and policies.
Legal Bases and Consent
Where the GDPR or UK GDPR applies, we rely on the legal basis appropriate to the activity: performance of a contract or steps taken at your request before a contract; compliance with legal obligations; legitimate interests such as securing and administering our business, preventing fraud, improving the Services, and handling legal claims, where those interests are not overridden by your rights; or consent where required, including for relevant marketing or tracking activities.
You may withdraw consent at any time without affecting the lawfulness of processing carried out before withdrawal. We do not treat agreement to the Terms & Conditions as blanket consent to every use of personal information.
Cookies and Similar Technologies
The Services use cookies and similar technologies for functionality and, where enabled and permitted, analytics, personalisation, and advertising. Where consent is required, non-essential technologies are subject to that consent. You can manage available choices through the website’s privacy or cookie controls and your browser settings. Restricting necessary functionality may affect your experience of the Services.
How We Disclose Personal Information
We may disclose information for legitimate purposes, subject to this policy and applicable law:
- To Shopify and providers supporting IT, payment processing, analytics, customer support, cloud storage, order fulfilment, and shipping.
- To business and marketing partners for marketing and advertising. This may include Shopify-supported personalised advertising using activity across merchants and websites. Partners process information under their own privacy notices. Available rights to object, opt out, or withhold consent depend on your location and the processing concerned.
- When you direct, request, or authorise disclosure, for example for shipping, social media widgets, or login integrations.
- To affiliates or entities within our corporate group, including the Imperial Crown family of brands, where there is an appropriate purpose and lawful basis. Group membership alone does not authorise unrestricted sharing.
- In connection with a merger, bankruptcy, or other business transaction; to meet legal obligations and valid legal requests; to enforce applicable terms; or to protect the Services and our rights or those of users or others.
Our Relationship With Shopify
Shopify hosts the Services and collects and processes information about your access to and use of them to provide and improve the Services. Information submitted through the Services may be shared with Shopify and relevant third parties in other countries for those purposes.
Where Shopify enhanced features are enabled, Shopify may use information about your interactions with our store, other merchants, and Shopify to protect, grow, and improve our business and provide those features. For processing for which Shopify is independently responsible, Shopify handles the related rights requests.
For details, see the Shopify Consumer Privacy Policy. Depending on your location, you may exercise rights through the Shopify Privacy Portal.
Third-Party Websites and Links
The Services may link to websites or platforms operated by third parties. Review their privacy, security, and other terms before using them. We do not control or guarantee their privacy, security, accuracy, completeness, or reliability.
Information shared publicly or semi-publicly, including on social media, may be visible to other users or third parties. A link does not by itself imply endorsement of a platform or its operator, unless expressly stated.
Children’s Information
The Services are not intended for independent use by children, and we do not knowingly collect personal information about children under the age of majority in their jurisdiction. A parent or guardian who believes a child has provided information may contact us to request deletion.
As of the date of this policy, we do not have actual knowledge that we “sell” or “share”, as those terms are defined in applicable law, personal information of individuals under 16.
Security and Retention
No security measures are perfect or impenetrable, and we cannot guarantee absolute security. Information may be vulnerable in transit. Please avoid insecure channels when sending sensitive or confidential information.
Retention depends on the purpose and applicable obligations, including maintaining accounts, providing Services, meeting legal requirements, resolving disputes, and enforcing agreements. We retain information only as long as necessary for those purposes and applicable legal requirements.
Your Rights and Choices
Depending on your location and the applicable conditions and exceptions, you may have rights to:
- Access personal information we hold about you.
- Request deletion of personal information.
- Correct inaccurate information.
- Receive a portable copy of information and, where applicable, request transfer to another party.
- Object to or restrict certain processing, including applicable rights concerning targeted advertising or sharing.
- Withdraw consent where processing relies on consent.
Residents of the European Economic Area and the United Kingdom may exercise the applicable rights of objection, restriction, and withdrawal of consent under local data protection law. Rights are not absolute, and a request may be declined only where the law permits.
You can unsubscribe from promotional emails using the link in those messages. We may still send non-promotional messages about your account or orders.
Exercise rights through the options provided in the Services or contact info@theskatelab.nl. For Shopify’s own processing, see its Privacy Policy and Privacy Portal linked above.
We will not discriminate against you for exercising your rights. We may need to verify your identity. Where the law allows an authorised agent to act for you, we may request proof of authority and direct identity verification. We will respond within the applicable legal timeframe.
Complaints
Please contact us if you have concerns about how we handle personal information. Depending on your location, you may appeal a decision or complain to the relevant supervisory authority. EEA supervisory authorities are listed by the European Data Protection Board.
International Transfers
Personal information may be transferred to, stored in, or processed in countries other than your own. For transfers outside the EEA or UK, we rely on applicable recognised safeguards, such as the European Commission’s Standard Contractual Clauses or relevant UK transfer mechanisms, unless the destination benefits from an applicable adequacy decision or another lawful transfer ground applies.
Changes to This Policy
We may update this policy to reflect changes in our practices or operational, legal, or regulatory requirements. We will publish the revised policy, update the date, and give any notice required by law.
